Minutes of the Heartland Apartment Association
Board of Directors Meetings

9/25/03, 7:45 A.M.

Pursuant to the e-mail notification dated September 15, 2003, the September Heartland Apartment Association Board of Directors meeting was held at the above stated date and time at the offices of Oddo Development Co., 8460 Nieman Road, Overland Park, KS.

Board members present were: Doug Price, Rick Oddo, Lee Harris, Dennis Watts, Jim Beverlin, Nick Moos, Jim Adams, and Ralph Lewis. Also present was Sam Alpert. (Ward Katz, Chris Erdley, Bill Charcut, Mike Cassin, Ron Nolan, Ken Riedemann, and Jerry Miller were absent.)

Rick Oddo called the meeting to order.

The minutes of the last meeting on 08/28/03, which had been previously circulated, were reviewed and approved by those present.

FHEO/ HUD- Sam Alpert commented on a second follow-up letter (included in the meeting package) he had written to Macie Houston subsequent to the May 15th meeting with HUD. He also reported that he had been in contact with Senator Bond's office in addition to having copied the correspondence to Senators Brownback and Roberts, both of whom had staff in attendance on May 15th. Meanwhile, all present agreed that the HAA should continue to engage HUD and to try to get the National Multi-Housing Council on board in support of the reforms we are promoting with regard to reducing the incidence of unwarranted investigations of "frivolous" fair housing claims.

KCMO FIRE INSPECTION FEE SCHEDULE- Sam Alpert reported that he and Lee Harris had co-authored a letter to Mayor Barnes (included in the meeting package) expressing HAA's outrage at the City Council's adoption of an ordinance containing a new fire inspection fee schedule without allowing for adequate public testimony. Alpert reported that while he had not received a response from the Mayor, he had met with Councilwoman Deb Hermann, who recognizes that the process was compromised, and has committed to revisit the issue in the Neighborhood Development Committee, which she chairs and which originally passed the ordinance out to the full Council.

OVERLAND PARK STORM WATER UTILITY- Sam Alpert reported that Dan Foster of Schlagel & Associates and Larry Winn have made some headway in getting the OP Public Works staff to reconsider a more equitable fee assessment schedule. City and county data is being researched to determine how best to facilitate an administrative change to the existing assessment system, which would enable the city to more effectively identify and bill property based on actual land coverage.

JOHNSON COUNTY WASTE WATER- Sam Alpert reported that talks are still underway with BOCC Chairwoman Annabeth Surbaugh. Doug Price indicated that an independent review of the Waste Water District's operations, rate structure, and billing practices had been commissioned by the JOCO BOCC. The HAA expects to be kept apprised of the review findings and to be advised of the BOCC's follow-up action.

MO "CONCEAL CARRY"- There was discussion over materials previously circulated by Sam Alpert regarding the new MO concealed firearms law schedule to take effect on October 11, 2003. There is a great deal of confusion with respect to the prohibition of concealed firearms on private property. It was recommended that owners seek legal counsel to determine if and how to properly post a property to prohibit "concealed carry" firearms.

NEW JERSEY "FORCED ACCESS" ANTI-TRUST SUIT- Sam Alpert discussed the implication of a major "forced access" anti-trust lawsuit in New Jersey which has named BOMA International among other significant defendants.

JOCO ENVIRONMENTAL SWIMMING POOL INSPECTIONS- Sam Alpert reported that he had been notified of JOCO Environmental's intent to double swimming pool inspection fees for 2004. Multifamily pools in major cities throughout Johnson County , excluding Overland Park, which has its own inspection regime, would be subject to the new inspection fees. There will be public hearings on the issue before year's end.

Sam Alpert and Doug Price requested that Board committees be formed to coordinate on-going projects such as "voter registration" and the continuation of HAA's efforts to reform the FHEO/HUD compliance enforcement process. After brief discussion, the following appointments were recommended:

Voter Registration: Alice Goeking and Tom Krevitt

FHEO/HUD: Jerry Miller

The next meeting of the HAA Board of Directors is tentatively scheduled to be held on Thursday, October 30, 2003, 7:45 a.m. at the offices of Oddo Development Co., 8460 Nieman Road, Overland Park, KS.

There being no further business to come before the Board of Directors, the meeting was adjourned at approximately 9:15 a.m.
