Board of Directors Meetings 9/26/02, 7:45 A.M. Pursuant to the e-mail notification dated September 16, 2002, the September Heartland Apartment Association Board of Directors meeting was held at the above stated date and time at the offices of Oddo Development Co., 8460 Nieman Road, Overland Park, KS. Board members present were: Doug Price, Lee Harris, Bill Charcut, Ward Katz, Rick Oddo, Ralph Lewis, and Chris Erdley. Also present were: Jim Beverlin, Bob Wise, Jim Adams, Dan Foster, and Sam Alpert. (Ron Nolan, Nick Moos, Ken Riedemann, Brent Blake, and Jerry Miller, were absent.) Bill Charcut called the meeting to order. The minutes of the last meeting on 08/29/02, which had been previously circulated, were reviewed and approved by those present. OVERLAND PARK STORM WATER UTILITY- Sam Alpert introduced Dan Foster of Schlagel & Associates who reported on the Overland Park "Storm Water Fee Lot Coverage Analysis" his firm had undertaken at the request and on behalf of Doug Price and the HAA. It was agreed that a broader sampling of properties (both multifamily communities and single family subdivisions) under various ownerships would be beneficial in furthering our discussions with Overland Park regarding the inequities of the current assessment process. HUD / FHEO- Sam Alpert and Doug Price reported that upon having spoken with some attorneys who routinely handle fair housing claims, it is clear that the great majority of these cases are frivolous. In order to provide a non-threatening forum in which to bring these concerns to HUD, it was recommended that a "Town Meeting" be convened. Participants would include owners, managers, attorneys of specific (fair housing claim) experience, federal legislative staff, and senior HUD officials. The ultimate purpose will be to encourage HUD to exercise both care and discretion to the limits of its authority in determining the merits of a claim before pressing for a financial settlement or subjecting an owner to a protracted in-depth investigation. FEDERAL REGS- It was noted that both OSHA and the EPA have been engaging in increased random federal compliance checks (for proper documentation) at properties throughout the area. Bob Wise suggested that we research the "Small Business Regulatory Enforcement Fairness Act (SUBREFA)". RESIDENT VOTER REGISTRATION- Sam Alpert suggested that resident voter registration should remain on the monthly agenda to ensure consistency. He indicated that on the Missouri side of Stateline, the Board of Election Commissioners can provide training and annual certification for on-site staff or establish on-site periodic registration dates for residents. In addition, Missouri residents can register at any public library, while residents of both Kansas and Missouri can register at the Department of Motor Vehicles when they renew their drivers license and / or vehicle registration ("Motor-Voter Act"). Kansas residents have the ability to register through the mail or on line. PRE-SESSION LEGISLATIVE EVENT- Bob Wise and Sam Alpert reported that a pre-session Kansas / Missouri legislative event is being planned. Along with key (some newly elected) legislators and select local officials, participants would include AAKC, BOMA, HAA, HBA, Kansas City Regional Realtors Association, MAA, Missouri Growth Association, and the National Federation of Independent Businesses. TELECOMMUNICATIONS FORCED ACCESS- Sam Alpert reported that Forced Access will be a priority issue again in 2003. Testimony of September 12, 2002 from telecommunications providers before the Economic Development Committee indicated a strong desire to push for access to "demarc points" within existing multifamily properties. KANSAS WATER SUB-METERING- Sam Alpert reported that he had been in contact with Clark Lindstrom of Peterson Properties in Wichita with regard to reconstituting a state-wide legislative initiative on water sub-metering. There has been some preliminary discussion with Jonathan Small (Topeka lobbyist who successfully advocated for pre-emptive rent control in 2001). The next regularly scheduled meeting of the HAA Board of Directors is to be held on Thursday, October 31, 2002, 7:45 a.m. at the offices of Oddo Development Co., 8460 Nieman Road, Overland Park, KS. There being no further business to come before the Board of Directors, the meeting was adjourned at approximately 9:45 a.m. | |
