Minutes of the Heartland Apartment Association
Board of Directors Meetings

6/27/02, 7:45 A.M.

Pursuant to the e-mail notification dated June 18, 2002, the June Heartland Apartment Association Board of Directors meeting was held at the above stated date and time at the offices of Oddo Development Co., 8460 Nieman Road, Overland Park, KS.

Board members present were: Bill Charcut, Ward Katz, Nick Moos, Jerry Miller, Doug Price, Lee Harris, Rick Oddo, and Chris Erdley. Also present were: Brad Oddo, Peter Engelman, Monte Wendler, and Sam Alpert.   (Brent Blake, Ralph Lewis, Ken Riedemann, and  Ron Nolan were  absent.)

Doug Price called the meeting to order.

The minutes of the last meeting on 05/30/02, which had been previously circulated, were reviewed and approved by those present.

There was discussion on a request from the AAKC for the HAA to provide funding in the amount of  $1,000.00 to facilitate a University of Missouri study on alternatives to property taxation. There was also discussion on a proposed amendment to the HAA Bylaws providing for an expanded Board of Directors and the extension  of  certain existing Executive Committee member terms. In the absence of a quorum neither topic of discussion could be put to a vote. Alternatively, Sam Alpert was instructed to poll the Board in order to facilitate action on both matters prior to the next regularly scheduled meeting.

Sam Alpert reported on current legislative activities (see attached) including:

KCMO Elevators – As the result of  concerns raised at the May 30, 2002 meeting, additional consultation with the state Elevator Safety Board and the KCMO Department of Codes Administration had been undertaken by Doug Price and Sam Alpert. It is now anticipated that Kansas City owners will soon be subjected only to  the KCMO elevator inspection regimen, eliminating the need for separate city and state inspections.

Overland  Park  Storm  Water  Utility – Sam Alpert requested Board members to provide actual assessment  and rentable square footage data  to be utilized  in support of arguing that  OP’s method of assessing multifamily properties is grossly inequitable. 

Johnson County Waste Water- Sam Alpert and Doug Price reported that the proposed water consumption based system of assessing waste water operations and maintenance charges may be the fairest way to proceed. However,  the unknown extent of additional administrative charges created by a proposed third party billing system (exclusive of Johnson County Waste Water and Water District No. 1) leaves a great deal of uncertainty with respect to the need for future rate increases.

FHEO- Ward Katz, Doug Price, and Sam Alpert reported on a June 7th meeting with HUD Regional Director Macie Houston and Deputy Director Terry Gratz. HAA concerns regarding  frivolous and unwarranted fair housing claims were discussed. HUD has agreed to  investigate the practices of its employees based upon past case histories submitted by regional owners (cases either expeditiously settled solely to avoid a protracted and  invasive investigation,  or dismissed for lack of substance). Sam Alpert indicated the need to provide requested files while HAA’s  initial approach to HUD on this matter is still fresh in their minds.

Chris Erdley reported that the KCMO City Council Operations Committee had held Street Closing fees issue in committee until July 10, 2002.

The next regularly scheduled meeting of the HAA Board of Directors is to be held on Thursday, July 25, 2002,  7:45 a.m. at the offices of  Oddo Development Co., 8460 Nieman Road, Overland Park, KS.

There being no further business to come before the Board of Directors, the meeting was adjourned at approximately 9:30 a.m.
