Minutes of the Heartland Apartment Association
Board of Directors Meetings

02/28/08, 8:00 A.M.

Pursuant to the e-mail notification dated February 20, 2008, the February Heartland Apartment Association Board of Directors meeting was held at the above stated date and time at the HAA offices, 2405 Grand, Suite 106, Kansas City, MO 64108.

Board members present were: Lee Harris; Rick Oddo, Chris Erdley, Jim Bowers, Dennis Watts, Bill Charcut, and Scott Buescher. Also present were Mary Jo Shaney, Kevin Smith, Jay Stock and Sam Alpert. (Ralph Lewis, Jerry Miller, Doug Price, Ward Katz, Ken Riedemann, and Jim Adams were absent.)

In Doug Price's absence Sam Alpert convened the meeting and introductions were made.

The minutes of the January 31, 2008 meeting were reviewed, but in the absence of a quorum upon commencement of the meeting, they were not formally approved by those present.

KCMO BUSINESS LICENSE LITIGATION- Sam Alpert, Jim Bowers, and Mary Jo Shaney led a lengthy discussion regarding the current process in preparation for a July trial date.

KCMO FIRE INSPECTION FEE REFUNDS - As reported last month, Sam Alpert indicated there had been a recent meeting with the opposing attorneys in Judge Del Muro's chambers, at which time she ordered that the City draft a letter to be sent to every business of record to communicate the possibility that a refund may be due the recipients (upon proof of payment). It appears that the city has agreed to the suggested dedicated mailing that will give business owners until June 30th to apply for their respective refunds. An official notice in this regard should be received by business owners within a couple of weeks.

FOLLOW-UP ON LENEXA, MISSION, and OVERLAND PARK RENTAL REGISTRATION INITIATIVES - It was reported by those in attendance that: 1) Lenexa had begun billing for 2008 license fees, and that the bills had been improperly calculated. 2) As was the case the previous month, Mission had been somewhat arbitrary in its inspection and citation procedures. An inordinate number of remedial monetary assessments had been experienced by several owners. 3) Rick Oddo reported Overland Park would soon enact a limited rental property registration program aimed at smaller scattered site rental properties. It is believed that this provision is merely a pre-cursor to a much broader measure that would eventually encompass all rental properties

NKC PROPOSED RENTAL LICNSING - Sam Alpert reported that he and the NKC Landlords Association met with NKC city officials to discuss a recently adopted updated property maintenance and nuisance code. It appears that license and program "fees" will again be a topic of discussion before the NKC City Council in the coming months.

NEW BUSINESS - Sam Alpert, Jay Stock and Jim Bowers reported that a number of far reaching and generally undesirable development, infrastructure, and environmental policy decisions will shortly come to light with regard to KCMO. Left to their own device, these decisions, many of which are "anti-business" by nature, along with a deeply troubling municipal financial environment, are all leading to a substantial stagnation in the area's growth.

The next regularly scheduled HAA Board of Directors meeting will be held on Thursday, March 27, 2008.

There being no further business to come before the Board, the meeting was adjourned at approximately 10:00 a.m.
