Minutes of the Heartland Apartment Association
Board of Directors Meetings


2/28/02, 7:45 A.M.

Pursuant to the memorandum dated February 20, 2002, the February Heartland Apartment Association Board of Directors meeting was held at the above stated date and time at the offices of Oddo Development Co., 8460 Nieman Road, Overland Park, KS.

Board members present were: Bill Charcut, Nick Moos, Jerry Miller, Doug Price, Rick Oddo, Brent Blake, Ralph Lewis, Lee Harris, Chris Erdley,  Ken Riedeman, and Ward Katz.  Also present were: Brad Oddo, and Sam Alpert.   (Ron Nolan was absent.)

Doug Price called the meeting to order.

The minutes of the last meeting on 01/24/02, which had been previously circulated, were reviewed and approved by those present.

Sam Alpert presented a year to date financial summary, which was reviewed and approved by those present.

Sam Alpert presented a brief overview of current legislative activities, including:

1.         KCMO elevator inspections and certification

2.         KCMO street closing fees

3.         Overland Park, Kansas storm water utility

4.         Kansas HB-Water Sub-metering Bill HB 2999

5.         Kansas and Missouri telecommunications “Forced Access”  legislation (SB593 and HB 1500                   Respectively)

6.         Missouri restriction on contract retainage (HB 1403)

7.         Missouri effort to enact simple majority for school bond issue elections (Senate version SJR 27 and House version HJR 32)

Ralph Lewis reported that recent FTC rulings may require more supportive documentation by landlords with regard to qualifying tenants subject to the Fair Credit Reporting Act.  Mr. Lewis also commented on the need to improve the judicial “Rent and Possession” process.   He is of the opinion that defendant tenants now have the ability to continue a case indefinitely, placing a plaintiff landlord at a clear disadvantage with regard to seeking final resolution.  Apparently, additional legislation is required to provide the Courts with a more rigid guideline restricting the defendant’s ability to unreasonably seek extension of the proceedings.

Jerry Miller and Doug Price led the discussion of the need to keep the AAKC informed of the HAA’s legislative activities, in an effort to consolidate industry efforts. There will be an effort made to initiate cross-representation at the legislative meetings of the AAKC and the monthly HAA meetings.

The next regularly scheduled meeting of the HAA Board of Directors is to be held on Thursday, March 28, 2002,  7:45 A.M. at the offices of  Oddo Development Co., 8460 Nieman Road, Overland Park, KS.

There being no further business to come before the Board of Directors, the meeting was adjourned at approximately 9:15 a.m.
