Minutes of the Heartland Apartment Association
Board of Directors Meetings

01/31/08, 8:00 A.M.

Pursuant to the e-mail notification dated January 21, 2008, the January Heartland Apartment Association Board of Directors meeting was held at the above stated date and time at the HAA offices, 2405 Grand, Suite 106, Kansas City, MO 64108.

Board members present were: Rick Oddo, Ralph Lewis, Jerry Miller, Doug Price, Jim Bowers, Dennis Watts, Bill Charcut, and Scott Buescher. Also present were Mary Jo Shaney, Jim Beverlin, Sam Scarfino, Lenora Carpenter, Debbie Haukenberry, Kevin Smith, Henry Lyons, and Sam Alpert. (Lee Harris, Chris Erdley, Ward Katz, Ken Riedemann, and Jim Adams were absent.)

Awaiting Doug Price's arrival, Sam Alpert convened the meeting and introductions were made.

KCMO BUSINESS LICENSE LITIGATION- After providing some background, Sam Alpert requested that Jim Bowers and Mary Jo Shaney brief those present on the current preparation of the case to be heard in mid-July, 2008.

The minutes of the December 6, 2007 meeting were reviewed and approved by those present..

KCMO FIRE INSPECTION LITIGATION - Sam Alpert reported that there had been a recent meeting with the opposing attorneys in Judge Del Muro's chambers, at which time she ordered that the City draft a letter to be sent to every business of record to communicate the possibility that a refund may be due the recipients (upon proof of payment). Jim Bowers suggested that the letter should be a dedicated mail piece and not included with other "junk mail" routinely sent out with water bills to save postage.

FOLLOW-UP ON LENEXA, MISSION, and OVERLAND PARK RENTAL REGISTRATION INITIATIVES - It was reported by those in attendance that: 1) Lenexa had begun billing for 2008 license fees, and that the bills had been improperly calculated. 2) Mission had been somewhat arbitrary in its inspection and citation procedures. It was recommended that owners begin recording incidents of what is perceived to be arbitrary enforcement on the part of the City. 3) Rick Oddo reported Overland Park had conducted a series of heavily biased (against "landlords") task force meetings moving toward the registration and licensing of rental housing in single family, duplex, and tri-plex buildings. It was suggested that Tess Raydo of Landlords of Johnson County, who serves on the task force, be made aware of HAA's concerns; and that she encourage more input from members of her organization.

NKC PROPOSED RENTAL LICNSING - Sam Alpert and Sam Scarfino of the NKC Landlords Association reported that the city of North Kansas City Mo. is again considering some form of rental unit licensing. On the evening of January 29th a meeting of rental property owners was held, and they were advised by the NKC Fire Chief that it was likely that the city council would soon take up discussion of rental unit licensing and inspection. This would be considered within the context of NKC's adoption of the updated 2006 International Residential Codes, as well as stronger property maintenance codes enforcement. There seemed to be little question that the city was looking for additional revenue in support of these initiatives, and that this would likely lead to some significant new registration or license fees.

NEW BUSINESS - Jim Bowers reported that the KCMO City Planning Commission would hear testimony regarding the Stream Set-back Ordinance and other Development Code issues on February 5th. He and Sam Alpert encouraged those present to testify.

The next regularly scheduled HAA Board of Directors meeting will be held on Thursday, February 28, 2008.

There being no further business to come before the Board, the meeting was adjourned at approximately 10:15 a.m.
