Pursuant to the directive issued at the May meeting of the HAA Board of Directors, Doug Price and Sam Alpert met with Larry Winn and Chase Simmons of Polsinelli, White, Vardeman & Shalton. The purpose of the meeting was to brief the attorneys on the current state of a pending staff recommendation to the Overland Park City Council regarding the registration of all residential rental units.

Initially, there needs to be a determination made as to the extent of existing "police powers" currently held by the city. This will help us to decide on a reasonable course of action with respect to any challenge we might contemplate. Upon researching this issue, counsel will brief the Board at our meeting of 6/24/99 as to their findings, and will recommend the appropriate course of action at that time.

Meanwhile, at the 6/2/99 meeting of the Overland Park City Council Community Development Committee, staff presented a registration recommendation summary for the committee's consideration. It is now our understanding that the issue is not scheduled to be heard again in committee until August. We have requested that the city clerk keep us apprised as far in advance as possible of any developments in this regard.
